Currently, one of America's top prediction market platforms has suspended player injury markets following intervention by the Commodity Futures Trading Commission (CFTC). The markets have been taken down, but the CFTC has not provided an official reason for their removal. Previously, however, the CFTC suggested that such markets might encourage insiders to place bets. They specifically considered prohibiting markets related to the duration, severity, or occurrence or medical diagnosis of a specific athlete, the kind Kalshi intended to offer traders. Nevertheless, this proposal has not yet been formalized into regulations, acting more as discretionary guidance than a strict framework. Industry observers have also pointed out the risk of insiders leveraging their knowledge of medical injury reports and return timelines, making these markets susceptible to manipulation and exploitation.

Player availability and injury reports are a smart way to leverage sports markets, yet they raise concerns.

Over the summer, injury reporting was introduced on the platform, featuring markets on athletes like Luka Dončić, Anthony Edwards, Malik Nabers, and Carlos Alcaraz. Subsequently, Kalshi offered NFL player availability markets. However, the CFTC has now intervened against this practice. The NFL has expressed its disapproval of these types of trades and has encouraged prediction markets to avoid offering them, particularly with the new season approaching.
