This reaction seemed unwarranted, especially since Santos had admitted to the offenses. He justified his actions by claiming he wanted to highlight the imperfect nature of prediction markets and how some people would make money they didn’t expect, while others would lose money. Kalshi also imposed a fine of $71,356, fully within its rights as a federally-licensed exchange, which added to the $35,000 fine from the Commodity Futures Trading Commission (CFTC), the regulatory body for prediction markets. Santos's engagement with these markets also impacted his political career, as he was expelled from Congress in 2023 and a year later pleaded guilty to federal wire fraud and identity theft. Although sentenced to seven years in prison, his sentence was commuted by President Trump after 84 days.

Kalshi stays above the fray, ensuring that those who err are held accountable for their actions.

It's important to mention that Santos has previously supported Polymarket, the main competitor of Kalshi in the United States, where Trump Jr. recently led a $300 million funding round and invested. Interestingly, Trump Jr. is also an advisor to Kalshi. Santos's remarks could be seen as either frustration or a suggestion that the White House might have chosen sides in the prediction market competition, favoring Polymarket. Beyond speculation, Kalshi's action against Santos marks a significant shift, clearly stating that regardless of who you are, engaging in insider trading will not go unchallenged by the platform.
